One day, a man drives his car to a bar to get something to drink, later that night he realizes he is too drunk to drive home so he hitches a ride on a horse.

It really can't get any weirder than that, and it actually happens that he did bring his horse with him to the bar for some odd reason, the guy drove his car and had his horse ride there in a trailer. The cops were called and caught him, but legally couldn't actually give him a ticket for a DWI.

Is he the smartest man ever, or the dumbest?

I guess you could say that he wasn't horsing around about his business.

Seriously though, you can get in trouble for walking in public while intoxicated. It's confusing to me that he got away without penalty while being intoxicated on a horse - which I'd imagine is a little more dangerous than simply walking around. Possibly could even be considered animal abuse for putting the horses life in danger with a drunk rider controlling the reigns. I don't know, but it just seems like he could have been punished in a hundred different ways. Maybe the police were just having a good night and decided that he was so clever, they'd just let him off with maybe a warning.

Now is he stupid or smart? I'd land on both. He's smart in the sense that he thought of it, and somehow ended up getting away with it. Like, I don't think many people ever decide to bring their horse to the bar to avoid paying a taxi fee. Yet he's stupid in the sense that he could have been in trouble in so many other ways. I am honestly just so confused as to how he got away with what he did - which in turn makes him smart again. Maybe incredibly lucky, either way works.

What he did was the exact definition of cleverness.  That's really all that needs said. 
Grand theft horse could have been enforced if it wasn't his.
