Sorry if I'm asking a dumb question but I found this really good background the other day that I would really like to use but, I discovered someone well known on the vizzed board had it. I just don't want to make anyone mad.

I would recommend you to not use it because that user may be pretty picky and become upset so no don't use it.
There are a ton more though great backgrounds you can find and using he or she's background could start a flame war or argument.

Although I will point out that in these instances it's better to just ask the person directly if you can use it rather than post a vague thread about it in the forums. You will probably get better results that way ;-)
