Hey there Gamers! The latest news in the video game world
includes the ongoing dispute and lawsuit concerning the use of Motorola devices that are compatible with Microsoft’s XBOX 360 console. The background to this story is that Motorola has asked Microsoft to compensate them for the use of their technology such as Windows 7, Internet Explorer, and Windows Media Player. The problem is that Microsoft disputes Motorola’s patent rights basically arguing that Motorola is unreasonable in its asking prices for the use of its products. This is bad news for Microsoft folks, and while this is not the typical article you see in Vizzed forums it has extreme repercussions on the gaming society, reason being; there is contemplation by these major companies and the US import /export offices to BAN the sales of the XBOX 360 console!!!! Motorola is asking Microsoft to pay them a percentage for each system sold. This legal battle has already cost both companies enough money that a Judge in Seattle was quoted saying “its enough to finance a small country.” Motorola has issued a Cease and desist order on all sales of XBOX 360 console sales in America.

How does this affect us? Guys this battle for Microsoft could send prices through the roof on ALL Microsoft hardware, including games. This could cause a backlash for Microsoft of tremendous size. No longer would people gravitate to XBOX leaving its competitors to reap the benefits. Microsoft is running out of room to negotiate and solve this problem folks and as usual it’s the consumers who are going to pay for it. Let’s all cross our fingers and hope they can reach a settlement because this war is effecting everyone worldwide.

This article is a few months old.... I never heard the end of it, either. The 360 is certainly still for sale. And the prices have not skyrocketed. I wonder what Microsoft used of Motorola's...

dumptruck : You are hugely wrong about the reasoning behind this lawsuit and what it means.

Microsoft and Google have had a huge feud and this is a part of that. This isn't a "Battle for microsoft" by any means. They have been going back and fourth about patents for years. In no way is Microsoft threatened. If you know how class action lawsuits work it's going to be years before they have to pay out any money. Heck, samsung just lost a huge multi-billion dollar lawsuit to Apple..and they aren't going out of business so don't be so over-dramatic.

The lawsuit is based around a few smaller points: The company sued Microsoft because its Xbox 360 console infringes five patents covering video decoding, Wi-Fi technology, and communication between hardware and peripherals.

Basically it's Motorola trying to protect themselves for their use of Android. They ultimately won the lawsuit against Microsoft but that basically will let them side step the money they might have lost from sharing their royalties on their smart phones.

Thanks for the constructive criticism Jordan.  Although I dont see how anything I wrote which was derived directly from what I read on GameSpot was "over-dramatic."  I simply read the article with the information they submitted and wrote a non-dramatic article on it in Hopes it would be a easy read.  Again I did not create any "reasonings" behind the article but I think if you actually read the same article i did you might not have come off so harshly. This isnt a thread for people with more experience to thrash new staff members in front of everyone on their thread and doing so is UN-professional.  If there was a problem with my article i wish you could've contacted me personally and I would have been very receptive to your points and edited the article. I am also new to writing articles for this site and have worked hard to maintain good etiquette and a fun tone with these posts.  If I did a poor job with this one then I apologize and thank you for correcting me.  I will work harder to make sure my information is more accurate.  And as a parting shot no, I dont know much about class action law suits, Im just a middle aged guy who has fun on this site and thought the article would be informative (assuming it was accurate which according to you its not) so I question where the "drama" is coming from.

dumptruck : I apologize if I came off harsh. Really what I was saying is that just because they lost this lawsuit doesn't mean that it spells the end of Microsoft which basically is what you could gather if you read your article quickly.

I was also just pointing out that the main points of the lawsuit were not what you had written in your original post and I saw that a few people were concerned about. I realize that I came off a little harsh. That was not my intention. I just wanted to clear the air so everyone had the facts.

Water under the bridge my friend.  I will double my efforts to make sure the articles are more fact and less speculation.

Jordanv78 : the date its listed as happening is passed anyway.
This wouldn't effect me, i have no Xbox, but i don't imagine it will be banned.
The ps3 had something similar
http://www.bbc.co.uk/news/technology-12607370
LG had ps3's banned in europe for a while, the ban is lifted but the case continues, idf they lose lg will have to pay for the costs of the seizure.

And heres a thread i made about this court case
https://www.vizzed.com/boards/thread.php?id=39216
I dont know if all that stuff is still banned or not.

What we are seeing here is not a gaming thing.

Its a new kind of war. a corporate war. Everyone is patenting anything that may be profitable in the future, even if they dont use it. Facebook paid a fortune for some of aols patents
http://www.bbc.co.uk/news/business-17820851
and google, really, is only buying motorola to gain there patents.

Everytime you use a design you end up paying a company for patents. This means to avoid infringement you have to take ridiculous technological detours to complete your project, or pay for a right to use there patent.
These costs are ultimately passed on to the consumer.
The potential benefit is that companys must continue to advance instead of using the standard tech.
Companys are all fighting as hard for each patent as countrys do over borders and maritime rule.
Many use the patents to pressure other companys, and often it has to go to court because theyre demanding unfair prices.
What normally happens is the two companys say, ok, you can use the patents we were suing you for for x many years, and you let us use the ones you were suing against, for x years.
So now when a company is sued for patents, instead of settling in court they go, i know, lets get some dirt on them and force them to the negotiating table.

Lets take the iphone. Literaly hundreds of components are patented in the uk alone, so for each component apple have to pay a few cents. Not much, but when you add up all the phones components, then all the yearly sales, suddenly thats a huge number.
All these costs are dumped on the consumers.
Patents are getting quite ridiculous.

The article was actually only meant to be a VERY brief synopsis of the CURRENT events in this dispute.  I was basing the idea on the Title, money.  While all the attention this topic has gained I think we all can agree that the common denominator is in fact money.  Thanks to all who participated in the information for this thread, although it got a little more in depth than i had liked I can see where the was a need to explain further for a referance point being that this tale is an ongoing and old one.

Well, it's nice for sense to be made of that fiasco. Thank you, Jordan. I'm completely unfamiliar with how the Patent world works since, in my view, it's like giant vs. giant with the cat rubbing your ankles. And we are the cats. (That's how I see it, so it really confuses me. xD)
