Good day folks.

I heard this story on a TV show about an Iowa dental assistant who was fired by her boss because she was considered "too attractive" and that her attractiveness "threatened his marriage." I waited to make a thread about this topic as it was only a trial court ruling.

But recently the Iowa Supreme Court ruled that employers can fire workers for being "too attractive" if the believe the attractiveness will result in problems with the marriage. The Iowa court said that this isn't Sex discrimination as the firing is based off of "feelings" rather then gender. Here is the funny thing...

The woman who is suing her boss says that she wasn't having an affair with her boss and the boss semi-confirmed it. Even thou the boss did make some rather suggestive text messages (such as asking the co-worker how often she has an orgasm), complained that the woman's outfit was so revealing that it distracted him from work, and treated her better then other employees. After the boss' wife found out about the text messages, the boss fired her to "protect his marriage."

So what do you guys think of this? Here are some questions...

1. Is this Sex discrimination or not?

2. Does it seem like the Boss was just trying to cover up his flirting or did he really care about his marriage?

3. Is firing someone because they are Attractive a valid reason for termination?

4. Will this be a case for the Supreme Court of the United States?

You know, as messed up as it is, it is not exactly sex discrimination. You can fire a guy for being too attractive too, if the situation were reversed.

I think he was trying to cover it up. But... since the whole thing is on the news... it's not exactly covered up any more, is it? XD

No, it is not. I would think it would just draw in more business, not harm the business. 
4. Will this be a case for the Supreme Court of the United States?
I think they will try to go to the United States Supreme Court, but I do not think that the Supreme Court will rule on it.

It would be sex discrimination if he had no females on his staff or fired every female he hired within a short time.  Just because she's a female and he's a male doesn't make it discrimination.

I don't know his strategy but when he fired her he gave the why to avoid conflict.  Or he's creating buzz and marketing like we're talking about it right now.  Who knows what other people think?

This is a weird one, maybe the boss didn't want to get himself in big trouble from being too attracted to said employee either way it's a bad decision anyways and he should not have hired in the first place if this was the end game

Yeah, I don't think you can truly call it "discrimination" in this case, but it's certainly something... Personally, I don't think it truly counts as "sexual discrimination" unless he has done this several times before, or any other different scenario occurs.

He definitely wasn't trying to cover up the flirting at all. It truly just seems like he was trying to protect his marriage. While there definitely were better ways to protect his marriage, it does seem justifiable by law.

It is discrimination. When you select people or fire them for reasons other than their ability to do the job that is discrimination. If you hired only woman that would also be discrimination, even if they attracted a ton of male customers, because you are being unfair in your selection, the males could potentially do a better job, but you want your staff to look beautiful.
That guy is a complete *sshole for firing her, and I would totally take it all the way for unfair dismissal. If she was late, had poor hygiene or scruffy uniform, a bad attitude, anything relevant to the job, it could be grounds for firing. But being the opposite gender? If i was only attracted to black people and fired a black person because i was afraid of jepordising my marriage, even though its not really racism, it is clearly wrong and pretty borderline because for all intents and purposes, im firing them over their race. To all intents and purposes, this woman was fired for her gender.
If that guy doesent have enough commitment to stay faithful, that's his fault.

Now we could say "attractive" is the group his is discriminating against, but then we are assuming. It could have been this ONE woman only who ever made him feel this way, and nothing to do with "attractive" people in general.

Why?

Just because you own the business.
I realize that this could lead to discrimination, which I disagree with.
But if we take antidiscrimination laws to far, then we might do something like say, force gay people to
eat at Chick ful A.

People refusing buisiness services or jobs to other individuals is just another 
way that they are allowed to protest.

If I was having trouble with someone,like that boss was, then I would probably fire her. . .
but I would make it happen on the best terms that I could, and help her get a job elswhere if
I could.

1. Well, I guess not. It could be a male in the position. It depends if the boss treated the employee right or not. If not, it's sex discrimination, otherwise, he's serious and thinks his wife is uglier.

What the heck? What has this world come to? You can't fire someone for being too attractive. That's just outrageous. The only reason I would fire someone from being too attractive is if the woman is doing sexual acts while on the job. Heh, job, yea, you know where that was going. I think this is completely ridiculous the way this happened, I mean come on, being fired for being too attractive?

That is silly, and this world has come to this and it is pretty weird. This is just a strange topic, it is one thing if it is sexual discrimination, and another if he abused her and mistreated her. But either way this is a weird topic and I think this is just ridiculous. I though the world was already pretty screwed up, and this just clearly exemplifies my point. Thank you for sharing such a weird topic XD. Guess they are just going to have to live with hiring ugly employees.
