Why do you ask? Do you download music from limewire, bearshare, etc. Do you use torrents? If so then why would this be any different if it is. first off, ill tell the yes: these games are not being sold anymore so its pretty much legal, kinda like how it says on games that aren't allowed for resale, yet you see them in game stop and on eBay.

by no now: these people want to make money off the games, but if they find it, they wont do anything to them. they will just let it sit there, so its like free candy that got stolen. [nice of me to put the "no" part in a way no one would like haha]. other than that, its pretty much legal. plus, id recommend it to anyone.

Well, it depends. If you own the game and just want to get a ROM for it to play on your computer, then it's legal. If you don't own the game, it's illegal. But to be honest, the chances of you getting caught are like the chance of you winning the lottery. If you don't run up to game executives and say "Look! I have a ton of ROMs on my computer!" you should be fine.

Really depends on the games you download, too. I'll use illegal downloading of music as an example, if you download tons of popular songs illegally, and keep them on your computer for years, you are testing your luck. Comparably, if you download a ton of games that are high profile, big name, huge in popularity, and games the companies even want to milk, you're doing something just as risky.

Now to compare downloading of more obscure music that may be under contract or trademark of the labels. Let's say you download a song from a band that is signed to Fueled By Rice or Metal Blade Records. All of these are big name companies.(Fueled By Rice isn't as well-known among the common consumer unless you do research, pay attention to the record company names on CDs, and simply go deeper than the skin. I just chose to namedrop that one since it has tons of artists we love to hate, but can't stop liking) When a company is a big name, it will care only about the stuff that is making the most money. If you downloaded something from Solid State Records and it was songs from the band The Agony Scene, they probably wouldn't care. If you downloaded some less popular songs and stuff from an artist who is signed to a Sony label, probably won't get in trouble.

Just like that, you won't be as much of a risk-taker if you're downloading less popular games. If a game is never gonna hit the states, like Mother 3, then you're probably good to go. If it's abandonware, it hardly matters if the game was able to exist pretty much. I've got a rom of a game based on the terrific short story I Have No Mouth and I Must Scream. It is still under copyright, but the author hardly cares. You can buy the game brand new still, but he doesn't seem to mind. Must be his hate for technology. Haha. Oh, and for people who wanna marry a man into sci-fi, don't marry men who hate technology and expressed contempt for microwaves in interviews.
