The lawsuit between West and Zampella V.S Activision will not see the courtroom after all. According to gamespot.com, the two sides came to a settlement outside of court. However, Neither side has come out and said what the two sides agreed on in order for settlement to have come to order.

One of the things that West and Zampella were trying to get was co-ownership of the rights to the Modern Warfare name. There have been no clues or announcements that this has happened or not. It seems that gamers are going to have to wait just a little bit longer to find out if the creators of Modern Warfare and Modern Warfare 2 will get the rights to the tile. Rumors are being thrown around that Activision paid dearly for a settlement. Some believe that all the money that was owed plus layer fees were taken care of. While others believe that everything that West and Zampella wanted in court was taken care of outside of court. There have been no official reports so it looks like we will have to wait and see as to what West and Zampella got with this settlement. The lawsuit with the other 40 ex-Infinity Ward employees has also been settled out of court which was reported on gamespot.com earlier this month.

Ok, so... West and Whoever created the first two, and Activision made the 3rd, and weren't suppose to? I am confused.

thenumberone : That was something that was brought up also that West and Zempella didn't even want to make a second Modern Warfare. That Activision forced them to make it and then fired them after making it not paying them a single cent for it.
