Why are cigarettes/tobacco legal?

I have noticed that there are few if any smokers commenting on this post, I have decided to give my to cents to equal out the perspective. Why isn't tobacco illegal?        1. Ask Al Capone how well prohibition works.   2. Europeans have been consuming tobacco since at least 1492 (Of course Columbus wasn't  the first European to reach the Americas but that's for another post.)  3. In my state the massive taxing of cigarettes goes to road repair and schools. ( so next time a tween complains about smoking think about your schools new computer lab.)   4. The pursuit of happiness. If what makes me happy is coughing up black ichor in the morning than so be it.

I can understand why it is legal, but it shouldn't be. Since it has no positive effects and only has negative ones, it shouldn't be legal.
