Going after fan games, or ROMs for that matter, seems like a lot of effort by Nintendo for really little to no gain. I'm sure by now they must have realized that once something finds its way to the internet it has gone beyond any realm of control. It's no longer something they can just delete or ask to have deleted.
If anything they will just cause fan game creators to complete and release their projects more quietly and Nintendo will again find itself chasing a ghost in trying  to delete something from the vast universe that is the internet.
