Now, I don't know if this rule associates with everyone else, but I know as of in the state of Pennsylvania this rule is pretty much a law for schools.
If you start a fight in school you will get suspended along with a fine in school. Explanatory, yes. But I bet you didn't know this. If you stand up and defend yourself against bullies or other people who are attempting to start a fight with you, you will also be suspended and fined.

Now explain to me how this is fair? Example, A kid comes up to you, and starts throwing punches, but instead you self defend yourself by hitting them back. And then you get in trouble too. Even if it's all caught on camera, you both will be punished.
Now if you were to walk away or not fight back after having the crap beat out of you, then you don't get in trouble? How does that make sense?

So i'm suppose to have my kids not fight back, and have them be beaten down so they don't get fined? What? (I don't have kids, it's an example).

Explain your thoughts on this.

Well I think that should change, I'm pretty sure there's a similar law here in SC. A child needs to be able to defend himself without being punished for it. Not only is the child being victimized by the instigator of the fight, but is being victimized by the school itself. Take it to the school board, let them know your complaint(if you haven't already).

You should be able to do either without punishment. Self defense isn't a bad thing, it shows that you are willing to stand up for yourself. The problem is with the schools, they're too paranoid about lawsuits or shootings that they adopted a Zero Tolerance attitude which obviously leads to unfair rules like this. For the record, our schools here in Ohio are similar to this although you won't get fined.

There's a difference between retaliating and simply defending yourself. Everyone should be able to defend themselves freely. I'm not just going to lie down and let someone beat the snot out of me.

Also, my question for you: Have you ever seen a kid confront someone and start punching them for no reason? I've seen several fights at school, none where someone gets randomly attacked for no reason.

Whenever I read ridiculous school rules like this, I cringe! Isn't high school supposed to prepare students for being adults in society!? It doesn't work like that in the real world, so why on earth should self-defense be fined in a high school? You have every right to defend yourself if someone physically assaults you, which is why the law allows for it. Whoever made up that rule is in la-la land.

Yes actually I have, When i was back in High School, there was a situation where this kid was being bullied because he was simply "larger". People would crack horrible jokes on him, and tell him to go puke up after lunch. It was disgusting. Towards the end of the year, a kid came out and confronted him, Pushed him into the corner, the kid being bullied tried to defend himself, but clearly wasn't able to. Then another person got involved, it was simply 2 on 1. The kid ended up in the hospital. I found out about this, and went to the principle and told him he better kick those kids out for what they did. The kid that ended up in the hospital got suspended for attempting to fight back..... And the 2 kids got kicked out for a year. "A year"...

I know that law all to well as I am from pa and ive been on both sides of it but it was never a bully thing. I never did understand why I got fined for defending myself but I also got violent when I was hit first. I will never agree with how the state works in this regard but the understanding is proper because no one wants to get sued

I always tell myself "people will be reasonable and judge every situation individually"... but that's not the case.

I would hope that if the kid had no other choice but to fight back, then the principle would be understanding and not dicipline him.

However, I think fighting is rarely the way out, and if a kid is being bullied at school, to walk away and report the bully will work much better. Many people think that if a kid does that they will just get bullied more... but the truth is that our society has becomed obsessed with how terrible bullying is, and if a kid is reported bullying, it likely won't be treated lightly, and the staff will make sure it all works out well for the victim. But then again, perhaps I am putting too much faith in people in this matter too.

regardless of the schools rules, real law trumps them. if you are smart enough to force the issue into court, youll find that you have a very large lawsuit on your hands. children are afforded every right adults are, save those restricted by age such as driving and using drugs. 

here in NY we have the same nonsense, minus the fine. the school officials arent lawyers, nor police. they dont understand law, and they dont have ANY right to do much of anything aside from speak to you. they do understand however, that they are told they have to suspend/expel/what have you, a child for various reasons. parents being stupid and lazy, and not really caring(not all parents, just the ones like this) about their childs rights and the way they grow up, dont try to push these issues. they allow the schools to spit in theirs and their childs face, shove a middle finger in front of it, and tell them that their rights are non existent because you are in a school.

through nearly my entire life i had to deal with this crap. id be picked on by groups of black kids for being one of the handful of white kids at the school, and id be forced to defend myself. weather i was assaulted by 5 guys, and got my ass handed to me, or got in a 1-on-1 and layed the smack down, the result was always the same. even if i didnt have the chance to defend myself, which happened a decent number of times, the result was still the same. suspend whoever is involved. it dosent matter if you defend yourself, and youll find this out if you get into this situation.
