Lazlo Falconi : consoleclassix does similar to what I do and they even charge money. Nintendo was going to take them to court but than Nintendo dropped the charges for some reason, maybe something to do with how consoleclassix owns a backup copy of every game and even multiple copies of games where more than 1 user can play the same game. Vizzed doesn't go to their extent but maybe eventually I'll get a lawyer and try to legalize this stuff better. But I know that Sega and Atari know of this site and I'm pretty certain that Nintendo and others do as well but no one besides Atari has asked me to take down games.

A lot of things on the internet were not legal to begin with. Youtube for instance was not legal cause they allowed people to upload copyrighted materials and till this day they still do. Another site is project playlist which use to allow you to download mp3's I believe they got sued as well.

ESA says its illegal but ultimately its the gaming companies who decide. Sega was fine with it, Atari was not it differs between each company. If they don't want their stuff on a site they will request removal. Until then, they don't care and that makes it legal.

Ignoring the question of whether or not owning a physical copy of a game gives you the right to own the ROM, it certainly doesn't somehow make it legal to let people play that game online. It'd be really hard to argue to a judge that these ROMs are being used as backups when anyone can signup and just play them.

My guess would be he argued that he was simply doing the rental system, where only a few games at a time were rented out (similar to GameFly--But without physical copies) and that he wasn't making enough money to significantly effect Nintendo. You should probably ask him some time. I've talked to him before and he's a pretty personable guy and he doesn't seem to mind answering questions about the company.
