Hacked games are still copyrighted because they are using the same code to the original creation along with the trademarked names of the company and the game itself. If I were to mod Legend of Zelda, then sell it and claim its mine you can bet I would get sued cause its not technically mine, I just modded their creation. Sure the modded version might be mine but in no instance does that mean I own copyrights to it unless the owner says I do.

This is not just for modded games it goes for anything that you mod and that is already copyrighted. Gaming companies probably don't like people modding their stuff. If you were to claim its yours and they find out you can get in serious trouble because they have all the proof to prove its theirs through actual registered trademarks and copyrights.

Hacked games yeah but homebrew and unlicensed games no.  There are surprisingly a ton of homebrew and unlicensed atari games.

Davideo7 : What exactly is a homebrew game? Is that a game that someone creates themselves and has never been available for sale & not officially distributed nor created by a gaming company? I think if you use certain characters or names that is more likely to be viewed as violating rights even if in a homebrew game however I also agree with you, homebrews (if I understand them right) are probably a lot harder to get in trouble with just as long as you stay away from profiting from licensed characters or titles. That would be my guess anyway, I know you can sue though over licensed characters.

JigSaw : Homebrew is a game created from the ground up.  They sometimes contain licensed characters but not always.  Most companies don't care about fan games though, the only time a company would probably take action is if that game was being sold for profit.

You can't just block the site so atari INC can't see them. You would have to be able to block it from not only every computer in their company that doesn't run on the exact same server, but you would have to be able to block the site from any home computer of every employee in the company, which is just not possible. No point in facing the lawsuit of an entire company. Besides, I doubt the atari games get played enough here to for it to even be worth the effort to try to keep.

Yeah the potential lawsuit could be pretty big if I went against Atari and kept the games, definitely not worth it.  I'll keep those game pages up though for people to discuss the games, see screenshots, review them, etc - they just wont be playable anymore.

It's best to remove the games so we don't get sued for copyright infringement.

If this was Nintendo, it could be a different story, you may see more of a fight with it, since it comprises a LOT of site traffic.

However, this is Atari, a company I don't think is worth the effort to fight. The games they took were few, and crappy. Aside from maybe 4 or 5 of those games, they weren't played often enough that you'd know of their existence unless you really loved atari for some reason.

It's a small blow. So small it's like a mosquito bite. Nothing serious yet, but this could be the start. Who knows? Atari could send Nintendo a message and get a ton of companies on Vizzed's ass. That'd be the worst case scenario.

For now, let's hope it ends with Atari. You said that Atari probably targeted Vizzed because they were making money from having those same games online. If that's true, Nintendo could be very dangerous.

Remember that Nintendo sells their old games online to Wii users. I'd bet they're losing money (minimum $5-$10) every time a user registers to play games on Vizzed instead of going on Wii Shop. No company would like that. If they put 2 and 2 together, they'll probably request that most of the Nintendo games in the RGR go away.

BNuge : I don't think they're actually making money off those games off their website.  I doubt Nintendo will make their games playable on their website but than again, who knows, Sega has already done it with Playsega.  I don't think I'm taking away $5-10 from Nintendo for each user who signs up on vizzed.  Most people probably don't even bother buying those Wii Console games (and some of those games you can get for dirt  cheap on ebay or at a garage sale) and for those who do, I doubt Vizzed will make them change their mind about getting them.  A lot of users play the games on here because they don't have the money to buy games so I really don't think I'm hurting Nintendo, if anything I'd be benefitting them because users are getting familiar with some of these old franchises and would be more likely to get the new games of these franchises.  Kid Icarus for example, if someone really enjoyed the original in the RGR that might make them familiar enough with the character and the franchise that they might consider getting the newest one.

If Nintendo was going to go after me than they should go after Gamefly because Gamefly hurts them just as much as I do since renting a game hurts a company due to the fact that the renter isn't buying the game.

This is unfortunate, I really enjoyed some of those games. I hope the hack version of those games are just as fun and playable.

Austin96 :

There's no use putting something back in that Davideo was asked to remove for the sake of not only himself legally, but for the site itself. And if nobody can even access the games since they would be locked away, then simply just what point is there to put them back on Vizzed in the first place

well i think i can live without some of  them games because i don,t play them that often but i think its bull because they already made money on theses games years ago so whats the big deal but on the other hand i wouldn't want a legal battle on my hands so do what you think is best for the site. i just hope no other systems do the same it could mean the end vizzed i would hate to see that.

That is rather lame, but it is Atari's prerogative. And if their main games are available on their own site then they are still out there.

Look on the bright side, more server space.

Thank sucks. Doesn't bother me personally any, but I guess it isn't too much of a loss anyways since it's pretty unpopular.

Any decreases in activity since the removal?

Is there not a way to buy the copyrights for the game. My example a church has to purchase the copyrights for each song that they sing during worship. This cost is about $150 for a year and they allow about 25 songs a month to be used and printed off by the church. I was just wondering if there was something out there like that for these games. Like people have said it would suck if Nintendo came and requested a bunch of games off this web site. However, talking to Davideo and with the ideas that he has to expand what this site has to offer. If Nintendo was to do this the site would be hurt, but with the ideas that are coming maybe in the not to far future it may not hurt as much.
