I believe the controversy spawns from the fact that Waluigi wasn't in the game in the first place. This confused some people, making them wonder if they missed him somewhere. And there was, in fact, a big black box that wasn't known to lead anywhere. So, people started assuming that there was some way to get into that area to find Waluigi.

It has been confirmed by Nintendo and several other people that have cracked the rom that in fact Waluigi wasn't even considered to be in the game at all; and the big black box that appeared was just a production error.

As pointed out by casualty, Waluigi was never in the running. Many people got so caught up in trying to find secret characters (which weren't helped by ROM hackers posting fake videos and screenshots of playing as Waluigi online or any number of supposed methods for getting him), they wanted find something. This can, actually, be traced back to the lack of Luigi in the original SM64. The whole missing Luigi thing, the idea that the statue in the courtyard said "L is real 2041", it sparked the idea that Nintendo was hiding something, and that thought carried over to the remake, spawning Waluigi hunts.

Just a rumor about a black box that concealed the hidden character Waluigi but it turns out that it was not true. Basically a repeat from the original SM64 Luigi rumor that people try to figure out whether it's possible or not to get these characters.

This made people make ideas of Waluigi out of some beliveable things, some things straight from Luigi in the original SM64, and stuff that's just plain stupid, like "seeing his face in the clouds", or "fight the Bunny King with 150 Stars"... none of those are true.
